The Dutch Antilles legislator has made sure that the SPF can be customized to almost every wish that a SPF-founder may have. The SPF-founder enjoys thus a great deal of freedom. The SPF can be set up for indefinite time or for a particular time. This is a clear difference with the regular trust. A so-called perpetual trust is not possible.
There are only a few limitations, all of which are beneficiary to the founder of the SPF. To name but a few: the SPF must be set up by a deed from a notary, the SPF must be registered in the registers of the Dutch Antilles Chamber of Commerce, the SPF-statutes must stipulate the manner in which the board of the SPF is appointed and dismissed.
Furthermore the SPF has to have a member of the board who or which is established in the Dutch Antilles. In the most cases the trust society will fulfill this position for the SPF-founder.
